How To Write A Debt Settlement Proposal Letter That Works
The verification letter should be sent via certified mail; this is an important step that provides the debtor with proof that the letter was sent within the stipulated thirty (30) day period. Once received, the debt collector must send proof to the debtor that the debt is valid. If no response is received from the creditor within thirty (30) days, the debt will be considered invalid.
Beginning on the date the debtor first receives a payment request from the debt collector (“initial contact”), they have thirty (30) days to send the validation letter. Initial contact from the collector may be by phone call or notice by mail. While the debtor may technically send a letter after thirty (30) days, the debt collector will have no legal obligation to respond.
The purpose of the validation letter is to inform the debt collector that the debtor 1) knows his rights under the Fair Debt Collection Practices Act (FDCPA) and 2) requests additional information to prove the debt is correct.
The debtor can either copy and paste the sample (below) into a new document or download the pre-written PDF or Word (.docx) version. The letter can be modified to match the tone and style of the sender.
How To Make A Debt Validation Letter
Once the letter is completed, the debtor should sign above their printed name. Although not a requirement, this adds a level of authenticity to the letter. The signature can be handwritten or digitally added with .
Take the signed letter to a nearby post office (for example, USPS) and send the letter via “Certified Mail with Signature Confirmation.” Sending the letter in this manner creates an official paper trail, allowing the sender (debtor) to prove that the letter was successfully delivered to the collector’s address within thirty (30) days.
Once the letter is delivered to the creditor, they will have thirty (30) days to respond. If a response is not received within this time frame, the debt is considered void under federal law, and the debtor may proceed without payment.
If the creditor tries to recall again, the debtor can send a cease and desist letter to the debt collector to stop all future collection attempts. However, because debt is often sold and resold, the debtor may need to issue additional cease and desist letters as time goes on.

If the debt collector responds with information regarding the debt, the debtor must carefully review all the documentation provided while looking for anything that may indicate a wrongly assigned charge.
If the debt is valid and has not passed the statute of limitations of the debtor’s state, the debtor can begin paying the debt. Alternatively, the debtor can try to reach an agreement with the creditor by sending him a letter of offer to settle the debt. With the letter, the debtor offers to make an immediate, lump-sum payment to the debt collector (for less than the total debt) in exchange for the abolition of the remaining debt.
Please note that this is not a refusal to pay, but rather a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g stating that your claim is disputed and validation is required.
